HIPAA and Translation

Responsive Translation is required by the Health Insurance Portability and Accountability Act of 1996, also known as HIPAA, to protect the confidentiality of the protected health information of covered individuals. The following HIPAA statement outlines how we do that:

Responsive Translation will use protected health information only as required for the purposes of translations ordered by our clients.

Responsive Translation will otherwise not use or disclose protected health information not provided for in this HIPAA statement or by client agreement, or as required by law. If we are required by law or court order to disclose such information, prior to any disclosure we will promptly notify the client in writing, attaching a copy of the legal demand and make reasonable efforts to allow our client an opportunity to seek a protective order or other judicial relief.

Responsive Translation will use appropriate safeguards to prevent use or disclosure of protected health information other than as provided for in this HIPAA statement or by client agreement.

Responsive Translation has implemented administrative, physical and technical safeguards (including written policies and procedures) that reasonably and appropriately protect the confidentiality, integrity and availability of electronic protected health information that it receives, maintains or transmits on behalf of clients, as required by the security rules. We will comply with the requirements of 45 CFR sections 164.308, 164.310, 164.312 and 164.316 in the same manner as our clients under those regulations.

Responsive Translation will mitigate, to the extent practicable, any harmful effect that is known to us as a result of use or disclosure of protected health information as provided in this HIPAA statement or by client agreement.

Responsive Translation will report to clients any use or disclosure of protected health information of which it becomes aware not provided for in this HIPAA statement or by client agreement.

Responsive Translation will ensure that any agent, including a subcontractor, to whom it provides protected health information that is received from Responsive Translation on behalf of a client agrees to the same restrictions and conditions that apply through this statement or by client agreement with Responsive Translation with respect to such information.

Responsive Translation will ensure that any agent, including a subcontractor, to whom it provides protected health information electronically will implement reasonable and appropriate safeguards to protect it.

Responsive Translation will make internal practices, books and records, including policies and procedures relating to the use and disclosure of protected health information received by Responsive Translation on behalf of our clients available to clients within seven days after receiving such a request.

Responsive Translation will document such disclosures of protected health information and information related to such disclosures as would be required for a client to respond to a request by an individual for an accounting of disclosures of protected health information in accordance with 45 CFR 164.528 within seven days after receiving such a request.

Responsive Translation will provide to clients an accounting of disclosures of protected health information in accordance with 45 CFR 164.528 within seven days of discovering such a disclosure. The notification shall include, to the extent possible, the identification of each individual whose unsecured protected health information has been or is reasonably believed by Responsive Translation to have been included in the disclosure, and such other information available to us that the client may by law be required to include in any notification to an individual pursuant to 45 CFR Section 164.404(c). To the extent that the client is obliged to provide notice pursuant to Section 13402 ARA as result of a breach of unsecured protected health information by Responsive Translation or our agent, we shall, upon written request of the client, provide such notice within seven days.
